A victory, but when will common sense prevail?

IceTV yesterday won the case brought against them (in May 2006) by the Nine Network who claimed copyright infringement of their TV schedule. Justice Annabelle Bennett, in her findings, dismissed the whole application by the Nine Network.
The essence is that IceTV, and other aggregators (Yahoo etc), are creating new compilations (which are copyright in their own right) which do not infringe on Nine’s copyright in their ‘Weekly Schedule’.
Whilst I wish IceTV well I don’t actually understand why we should have to pay $3/week for an electronic program guide for our PVR’s.
It would be a short-cut to common sense if the federal government regulator simply required anyone broadcasting a digital TV channel to provide a weeks worth (preferably two) of electronic program guide for transmission too.
